NOTICE OF PUBLIC HEARING TO ACT ON PROPOSED
AMENDMENT TO ZONING ORDINANCE
As required by Section 11-52-77, Code of Alabama, 1975 as amended: Notice is hereby given that a regular meeting of the City Council of the City of Guntersville, Alabama to be held in the Guntersville Town Hall, Guntersville, June 15th, 2020 commencing at 6:00 P.M., said City Council will hold a public hearing upon a proposal requested by the Planning Commission that it, the said City Council, adopt an Ordinance in words and figures substantially as follows:
AN ORDINANCE TO AMEND CERTAIN PORTIONS OF THE “ZONING ORDINANCE OF THE CITY OF GUNTERSVILLE, ALABAMA” (ORDINANCE NO. 1042 ADOPTED JUNE 3, 2013) AND TO ALTER AND CHANGE THE “CITY OF GUNTERSVILLE, ALABAMA ZONING MAP” REFERED TO AND IDENTIFIED IN SECTION ONE, SHORT TITLE, OF SAID ORDINANCE.
WHEREAS, the Public Welfare requiring it and pursuant to and under the authority conferred by Code of Alabama 1975, as amended, Section 11-52-70, et. Seq., be it therefore,
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GUNTERSVILLE, ALABAMA, that the following described property (Parcel #1501111000002001), belonging to Harbor Properties, is here by changed from I-2 to BG-1A and hereinafter shall be classified as such, subject to all rules, regulations and requirements set forth in the zoning ordinance of the City of Guntersville, Alabama and as amended to wit:
Tract 1: Beginning 40 feet North of the Southwest corner of the Southwest fourth of Section 21, Township 8, Range 3 East; Thence North 4 chains; to the North margin of the right of way; thence West 9.5 chains to beginning point, said land lying and being in Marshall County, Alabama, and containing 4 acres, more or less.
Tract 2: Commencing at the Southwest corner of Section 21, Township 8 South, Range 3 East in Marshall County, Alabama; thence North 304 feet to the Southwest corner of Lot 10 Block 3 in Cherokee Hills, a subdivision recorded in Plat Book 6 Page 26 in the Probate Office of Marshall County, Alabama, the point of beginning for the property here in described; thence North along the West line of said lot 315 feet; thence in a Southeasterly direction along the Southwest margin of Lots 11 and 12 in Block 3 of said Cherokee Hills 224.4
feet, thence South 56 degrees 42’ East 147.4
feet to a corner of Lot 9 in Block 3 of said Cherokee Hills; thence South 20 degrees 41’ West with an extension of the West boundary line of said Lot 9 a distance of 81.16
feet to a point of the South boundary of said Lot 10; thence West along the South boundary line of said Lot 10 a distance of 212.13
feet tot the point of beginning and being a part of Lot 10 in Block 3 of said Cherokee Hills Subdivision, and being subject to those certain restrictive covenants pertaining to said subdivision recorded in Deed Book 456 Page 704 in the Probate Office of Marshall County, Alabama.
